Terms of service

1. The agreement

These terms are an agreement between the business that installs Marka Cart Drawer on a Shopify store (“you”) and Marka Modern Retail Private Limited (“we”, “us”). By installing or using the app you accept them. Shopify’s own terms continue to apply to your store and to the Shopify App Store. Our privacy policy explains how we handle data and is part of these terms.

2. The service

Marka adds a cart drawer with offers, bundles, add-ons, popups, recommendations, experiments and analytics to your Shopify online store, through Shopify’s theme app extension, Shopify Functions, a checkout UI extension, a web pixel and Shopify Flow triggers. It needs a Shopify store with the Online Store sales channel. The checkout-page block only appears on Shopify Plus stores; everything else works on every Shopify plan. Discounts are applied by Shopify at checkout; the drawer shows previews.

3. Plans, trials and billing

All charges are made through Shopify’s billing system and appear on your Shopify invoice; we never ask for your card. You can upgrade, downgrade or cancel at any time on the app’s Plans page. Uninstalling the app cancels the subscription.

Plan limits are described on the Plans page; order counts there are guidance for choosing a plan and never switch off your storefront. A new price never applies to your subscription until you approve the charge in Shopify.

Cancel any time, no refunds. You can cancel whenever you like by switching to the Free plan or uninstalling the app; no further charges are made after that. Fees already charged are not refunded, including for part of a billing period or for features you did not use, unless the law requires a refund. If you cancel during a free trial, you are not charged. Any credit Shopify’s billing system applies on its own when you change plans is not affected.

4. Your responsibilities

• Set up offers, prices, texts and conditions that are accurate and that you are willing to honour at checkout.
• Comply with the laws that apply to your store — consumer protection, pricing and discount rules, and privacy law — in every market you sell to, including having your own privacy policy and cookie banner.
• Keep your Shopify staff accounts secure and only give access to people you trust.
• Do not use the app for anything unlawful, deceptive or harmful, and do not try to break, overload or reverse-engineer it.

5. Audiences, personalised offers and pricing laws

Audiences let you choose which offers, popups and add-ons are shown to groups of shoppers (spend tier, purchase segment, interests, live intent). Laws on personalised pricing are changing. When an offer that changes a price or discount targets an audience, Marka shows the disclosure New York requires for prices set by an algorithm using personal data to visitors in the United States, and the notice required in the European Union to EU visitors — you cannot switch the US wording off. You remain responsible for deciding whether and how to use audiences in your markets. We recommend using audiences to decide which offer a shopper sees rather than charging different prices for the same product, and asking your legal adviser before targeting price changes.

6. Data

You own your store data. We process your customers’ data on your behalf as described in the privacy policy, using Shopify protected customer data Level 1 and the Level 2 fields email, phone and address (never names) — kept encrypted, only to recognise the same customer across guest checkouts and duplicate customer records of your store and to personalise its recommendations. The app never contacts your customers and never uses your store’s data for another store. You remain responsible for your store’s own privacy policy (section 13 of the privacy policy suggests a paragraph). Our data processing agreement is part of these terms and applies automatically.

7. Availability and support

We work to keep the app available and to fix problems quickly, but we do not guarantee uninterrupted or error-free operation. If the drawer ever causes a problem on your storefront, switching off the app embed in your theme editor restores your theme’s own cart immediately. How to reach us: support.

8. Intellectual property

The app, its code and its design belong to us or our licensors. While your subscription is active you may use the app for your Shopify stores. Content you add (texts, images, settings) remains yours; you allow us to use it only to provide the app to you.

9. Warranties and liability

To the extent the law allows, the app is provided “as is”, without warranties that it will meet every need, and our total liability for any claim relating to the app is limited to the fees you paid us for the app in the twelve months before the claim. We are not liable for indirect or consequential losses such as lost profits. Nothing in these terms limits liability that cannot be limited by law.

10. Ending the agreement

You can stop at any time by uninstalling the app. We may suspend or end access if you seriously breach these terms or if the law requires it; we will tell you first where we can. After uninstall your data is deleted as described in the privacy policy.

11. Changes

We may update these terms. We will publish the new version here with a new effective date and tell you in the app or by email before a material change takes effect. Continuing to use the app after that means you accept the new terms.

12. Governing law

These terms are governed by the laws of India. The courts at Gurugram, Haryana, India have exclusive jurisdiction over any dispute arising from them or from the app. The transfer safeguards in the data processing agreement follow their own governing law. Nothing in this section takes away protection that the mandatory law of your country gives you.
